Introduction and Acceptance of Terms

Welcome to Cars in Lobo Trade AS ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our car selling services, website carsinlobotrade.com, and any related services (collectively, the "Service").

By accessing or using our Service, making a reservation, or renting a vehicle from us, you agree to be bound by these Terms. If you disagree with any part of these Terms, then you may not access or use the Service. These Terms constitute a legally binding agreement between you and Cars in Lobo Trade AS.

We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Service following the posting of changes constitutes your acceptance of such changes.

Eligibility and Requirements

To rent a vehicle from Cars in Lobo Trade, you must meet the following requirements:

• Age Requirement: You must be at least 21 years old. Drivers under 25 may be subject to additional fees and restrictions.
• Valid Driver's License: You must possess a valid driver's license that has been held for at least one year. International customers may require an International Driving Permit (IDP).
• Credit Card: You must have a valid credit card in your name for security deposit and payment purposes.
• Clean Driving Record: You must not have any major moving violations or license suspensions within the past three years.
• Legal Capacity: You must have the legal capacity to enter into binding contracts.

We reserve the right to verify your eligibility and may refuse service if requirements are not met or if we determine that renting to you would pose an unacceptable risk.

Selling Agreement and Reservations

Making a Reservation

Reservations can be made through our website, by phone, or in person at our Oslo location. All reservations are subject to vehicle availability and confirmation. A reservation does not guarantee a specific vehicle model, but we will provide a vehicle in the same class or better when possible.

Selling Agreement

Upon pickup, you will be required to sign a selling agreement that includes:

• Selling period and return date/time
• Authorized drivers
• Mileage allowance and restrictions
• Insurance coverage options
• Vehicle condition assessment
• Payment and deposit information

Modifications and Cancellations

Reservations may be modified or cancelled subject to our cancellation policy:

• Free Cancellation: Up to 24 hours before pickup
• Late Cancellation: Cancellations within 24 hours may incur charges
• No-Show: Full selling charges may apply for no-show reservations

Vehicle Use and Restrictions

Authorized Use

You may use the selling vehicle only for lawful purposes and in accordance with these Terms. The vehicle may only be driven by:

• The primary renter named in the selling agreement
• Additional drivers listed in the agreement who meet our requirements
• The renter's spouse or domestic partner (with valid license)

Prohibited Uses

You may NOT use the selling vehicle for:

• Racing, speed contests, or any competitive driving events
• Off-road driving or on unpaved roads
• Towing or pushing other vehicles or objects
• Commercial transportation of passengers or cargo
• Driving under the influence of alcohol or drugs
• Any illegal activities or violations of traffic laws
• Transport of hazardous materials
• Driving outside of Canada without prior written authorization

Vehicle Condition and Maintenance

You agree to:

• Return the vehicle in the same condition as received
• Maintain proper fluid levels and tire pressure
• Use only the appropriate fuel type
• Report any mechanical problems immediately
• Not make any modifications to the vehicle

Pricing and Payment

Selling Rates

Selling rates are determined based on vehicle class, selling duration, season, and other factors. Published rates do not include:

• Taxes and government fees
• Optional insurance coverage
• Additional driver fees
• Equipment sellings (GPS, child seats, etc.)
• Fuel charges
• Late return fees

Payment and Security Deposit

Payment and security deposits are processed using your credit card. We may place a hold on your card for:

• Estimated selling charges
• Security deposit (typically 1500-5000 NOK depending on vehicle class)
• Potential additional charges (fuel, damages, violations, etc.)

Additional Charges

You may be charged additional fees for:

• Excess mileage beyond the agreed allowance
• Late return (grace period of 29 minutes, then hourly charges apply)
• Refueling if returned with less fuel than at pickup
• Cleaning fees for excessive dirt or odors
• Smoking in the vehicle (minimum 2000 NOK)
• Traffic violations or parking tickets incurred during selling

Insurance and Liability

Included Coverage

All sellings include basic insurance coverage as required by Norwegian law, including:

• Third-party liability insurance
• Collision damage waiver (with deductible)
• Theft protection (with deductible)

Optional Coverage

Additional insurance options are available to reduce your liability:

• Premium Protection: Reduces deductibles to zero
• Personal Accident Insurance: Coverage for medical expenses
• Personal Effects Coverage: Protection for personal belongings

Your Responsibility

You are responsible for:

• Damages not covered by insurance
• Deductible amounts for covered damages
• Damages resulting from prohibited use
• Loss of vehicle keys (replacement cost: 1500-3000 NOK)

Return and Inspection

Vehicles must be returned:

• On or before the agreed return date and time
• To the designated return location
• With the same fuel level as at pickup
• In the same condition as received
• With all keys, documents, and equipment

We will inspect the vehicle upon return and document any changes in condition. You have the right to be present during this inspection. Any damages or missing items will be charged to your credit card according to our damage assessment policy.

Limitation of Liability

To the maximum extent permitted by law, Cars in Lobo Trade's liability is limited to the amount paid for the selling. We are not liable for:

• Indirect, incidental, or consequential damages
• Lost profits or business interruption
• Personal property left in the vehicle
• Delays or inconvenience caused by vehicle breakdowns
• Costs of alternative transportation

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so these limitations may not apply to you.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information in accordance with our Privacy Policy.

Dispute Resolution

These Terms are governed by Norwegian law. Any disputes arising from or relating to these Terms or your use of our services will be resolved through:

• First: Good faith negotiations between the parties
• Second: Mediation if direct negotiations fail
• Final: The courts of Oslo, Canada, which shall have exclusive jurisdiction

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.
